Local woman sues Chipotle over GMO-free claims

A San Diego woman has filed a class action lawsuit against Chipotle, but it has nothing to do with food safety issues.

Team 10 learned the woman's suit focuses on GMOs and the way Chipotle advertises its food.

According to the lawsuit, Chipotle represents to customers that if they eat at the restaurant, they will not be eating GMOs.

But, as Chipotle told consumers it was "G-M-Over it," the opposite is true.

The lawsuit alleges the ingredients in Chipotle's menu items have never been free of GMOs at any time.

The suit says the San Diego woman would not have purchased from Chipotle at the price she had paid, or purchased it at all, had she known that the representations made concerning Chipotle's food products were materially false and misleading.

The attorney who filed the suit told Team 10 they would like to see accurate advertising from Chipotle.

Chipotle issued the following statement to Team 10 Thursday night:

"There is no merit to this and we will contest it. We have always been very transparent in the running of our business, and that includes the claims we have made about our use of non-GMO ingredients."
