Car hits 12-year-old's bedroom, no arrests made

OCEANSIDE, Calif. (KGTV) -- The family was asleep in their home when a car came barreling through their house — hitting the wall just feet from where a 12-year-old boy was sleeping. On Thursday night they told 10News that they’re outraged that no one was arrested because police couldn’t tell who was driving.

The 12-year-old's father says he knows exactly who was driving, because he was the one who pulled the driver out of the flipped car.

“I was asleep with my fiancé, and my son comes yelling in my room, a car just hit our house," said Marcus Castaneda. 

It was 5 a.m. when Castaneda came running out to find the black Nissan Altima upside down in his yard. He says three people were inside - half conscious and covered in blood. 

“The lady inside the driver’s seat, she was screaming, my arm, my arm is hurting, this and that," Castaneda said. 

He pulled the three out and called 9-1-1.While he helped them, he noticed that the car reeked of booze.

"As you can see all the debris, nails, glass, beer bottles, liquor bottles everywhere," he said. "The two men were extremely drunk, as was the woman, and they sat them down on the curb, and they  had interviewed the guys.”

Paramedics rushed the woman away while police questioned the men — who Castaneda says, weren’t cooperating at all. Castaneda was most shocked when the two men who were in the car were suddenly released. 

Weeks have passed since his son was almost killed, but there's still no word of any arrests. 

"If the car was 10 feet more to the right, it would have gone right through the wall, and it would have killed my son," he said. 

10News asked the Oceanside Police Department if any arrests are coming. Police say they passed our questions to the traffic division. We’re still waiting to hear back from them.
