Red-Light Camera Defense Files Motion

Lawyers Want City Attorney Dropped From Case

The lawyers defending hundreds of San Diego drivers caught by red-light cameras want the city attorney removed from the cases, 10News reported.

The defense team filed a motion Monday in Judge Ronald Styn's court asking that City Attorney Casey Gwynn be recused from acting as prosecutor in all pending red-light camera cases.

Defense attorney Christopher Plourd contended that Gwynn has a conflict of interest because he represented the city in its contract with Lockheed Martin IMS, Inc., which owns and operates the cameras.

According to Plourd, the contract between the city and Lockheed Martin was negotiated, approved and signed by Gwynn.

If the judge agrees that a conflict of interest exists, the district attorney, or California's attorney general, would take over prosecution of the cases.

Gwynn's office said Monday that the motion is without merit, and that they will respond in court on August 31.
