Report: Man Shot By Harbor Police Was On Drugs

A man who was shot to death by a harbor police officer after being pulled from San Diego Bay last month had narcotics, including methamphetamine, in his system at the time, according to coroner's reports released Tuesday.

In addition to the illegal stimulant, Steven Hirschfield, 37, had a small amount of ketamine -- a veterinary tranquilizer sometimes used as a club or date-rape narcotic -- along with doxylamine, a sedative/antihistamine, in his bloodstream when he was shot in the back on July 19, according to the county medical examiner's office.

That night, Hirschfield, an actor and dancer from West Hollywood who had been hired to entertain on a charter cruise as part of Gay Pride Day festivities, jumped off the boat into the bay about 11 p.m., according to an autopsy report.

The crew of the yacht, the Hornblower Inspiration, sent a rescue vessel to pick Hirschfield up, but he refused to board it and began swimming toward shore, which was about 500 feet away, according to the document.

Responding to an emergency call, San Diego Harbor Police Officers Wayne Schmidt and Clyde Williams intercepted Hirschfield and, when he declined to get into their vessel, pulled him aboard, the report states.

At that point, Hirschfield allegedly became violent, knocking Schmidt to the deck of the vessel and striking him in the face with his stun gun.

He then allegedly tried to grab Schmidt's pistol, prompting Williams to open fire. Hirschfield died at the scene.

The Medical Examiner's Office initially reported that Hirschfield died of a chest wound. The report released today contains the same conclusion, but states that the .40-caliber hollow-point slug that caused the lethal injury entered Hirschfield's back and shattered his spine before exiting his right pectoral area.

The dead man's parents have filed lawsuits seeking $20 million from Williams and the harbor police department.

Attorney Brian Claypool, who represents Hirschfield's family in the case, did not immediately return a telephone call seeking comment on the final postmortem test results. He has scheduled a news conference for Wednesday.

In previous public statements, Claypool has countered the official version of the events that led to shooting, which he branded a "needless and unjustified execution" by a "renegade officer."

The lawyer also has suggested that the shooting may have stemmed from an "anti-gay sentiment."

Claypool has described the combative behavior attributed to Hirschfield as "completely out of character" and has said that the dancer's body bore no signs of a physical struggle.

Schmidt, however, was treated for face and leg injuries at a hospital following the altercation.

The attorney also has argued that it would have been physically impossible for Hirschfield to fight with the officers after swimming and treading water upwards of 30 minutes.

Schmidt and Williams are serving desk duty pending completion of internal investigations into the shooting, according to harbor police officials.
