NEW YORK - Eateries from corner delis to movie concession stands have gotten a last-minute reprieve from New York City's groundbreaking ban on big sugary drinks. But Mayor Michael Bloomberg is urging them to shrink their cups and bottles, anyway.
 
A Manhattan judge on Monday struck down the ounce size limit for sodas and some other sweet drinks. It was set to take effect Tuesday.
 
The judge said the rule was arbitrary and outside city health regulators' purview.
 
Bloomberg says the city plans to appeal and expects to win. And he says that "common sense" suggests businesses should stop doing something if they know it's harmful to people's health.
 
City officials point to the city's rising obesity rate and studies tying sugary drinks to weight gain. Opponents call the rule unfair and wrong-headed.
