San Diego Harbor Police say Comic-Con attendee's injuries came from fall

Girl, 17, found injured near hotel's pool area

SAN DIEGO - A 17-year-old Comic-Con attendee found injured near a hotel pool early Sunday morning suffered those injuries in an apparent fall, according to San Diego Harbor Police.

A Harbor Police investigation found that the girl's injuries "were not the result of a criminal assault, and were likely the result of a fall. Her injuries, and physical evidence at the scene, were consistent with a fall from the distance of approximately six feet."

Police said investigators reviewed surveillance camera footage, looked at various photos submitted and spoke to community members and Comic-Con attendees in coming to their conclusion.

In connection with the case, 29-year-old Justin Kalior was arrested and accused of sexual contact with a minor and contributing to the delinquency of a minor. Despite the investigation's findings, Harbor Police said "charges against" Kalior "will be forwarded to the District Attorney's Office."

Harbor Police told 10News that the girl and the suspect "knew each other. They were together for the day at Comic-Con."

10News learned the teen was a cosplayer -- one who dresses up in costume to portray a character -- and she came to the event dressed as a female version of Roger Rabbit with bright red wings and bunny ears.

Kalior, who is from the Los Angeles area, made bail. If charges are filed, he will make his first court appearance on Aug. 5.
