VISTA, Calif. - Family members want answers after a North County man was stunned with a Taser by a sheriff's deputy and is now in the hospital.

Holding her young son and through tears, Angelica Tudela said when she went to see her common law husband Marcial Torres, "he looked really bad."

10News learned Torres was stunned with a deputy's Taser three times about a week ago in the parking lot of a 99 Cent Store in Vista.

"At this point, we don't know what happened that led him to be in the hospital," said attorney Eugene Iredale, who is co-counsel hired by the family.  

Sheriff's investigators say Torres was part of a group of men who threatened another man with a gun. A description was given to authorities by the victim's son, according to investigators.

Torres suffered a heart attack and slipped into a coma after the Taser incident, and he has been in the hospital ever since.

Investigators say he has not been charged with anything yet.

"I do have confirmation there is a video," said Christine Denning, another attorney for the family.

The video purportedly shows what happened through surveillance cameras in the store parking lot.

Sheriff's investigators told 10News they will not comment on any evidence that was seized, but did say Torres will be arraigned on charges as soon as he is well enough.
