SAN DIEGO -
The local judge who claims President Obama is not a U.S. citizen has the NAACP speaking out on Tuesday.
Judge Gary Kreep is in the first month of his new job as Department 3, Superior Court judge in San Diego. It is a position he could not take until giving up his old gig, which is one that concerns Douglas Oden, an attorney with the National Association for the Advancement of Colored People.
"He's elected," said Oden. "He has a right to do the job, but we demand that all judges be fair and impartial, and we will judge him by that."
Kreep was executive director of the United States Justice Foundation, a right-wing organization most noted for its fight to prove Obama is not a U.S. citizen.
"For you to – at this stage – contend that he is illegitimate and a fraud, that causes us concern that he can be fair and impartial when the average citizen goes before him," said Oden.
10News reached out to Kreep's offices, spoke to his coworkers, left messages and sent emails but have not heard back.
Last year, his latest efforts to discredit the president were thrown out by the U.S. Supreme Court. Kreep claimed that Obama was born outside the United States and to only one American parent, meaning he is not a "natural born citizen" and could not be president. That is something the White House later combated by releasing Obama's Hawaiian birth certificate.
"That's all we ask... that he admits that President Obama is the legitimate president of the United States," said Oden.
Most of Kreep's cases in Department 3 are procedural and involve mostly misdemeanors and do not leave much room for interpretation.
