A former employee told 10News she saw instances of negligence at a local day care center where a young child recently died.

On May 23, just five days from his first birthday, Louis Michael Oliver suffered head and spine trauma at San Diego Daycare, in the 4300 block of Mount Davis Avenue in Clairemont. He died at Rady Children's Hospital from his injuries on May 24.
Earlier this month, the San Diego County Medical Examiner's Office ruled Louis' death a homicide.
10News learned James Nemeth ran San Diego Daycare since 2009 until the facility's license was suspended by the state in July.
Erick Edwards said she feared a tragic incident would happen at the day care center.
"I wouldn't have trusted him with my kids, basically," Edwards said of Nemeth.
Edwards told 10News she worked for Nemeth in 2009 for about six months. She said she began seeing negligence and mistreatment almost immediately after she started working at the center.
"There was a kid there that was being treated poorly at home. That was never reported," Edwards said.
While San Diego Daycare touted quality care on its website, Edwards told 10News the center was also endangering children.
She claimed allergy warnings were ignored and kids were locked in rooms for hours alone. At times, Edwards said she struggled to look after as many as 15 kids on her own.
"He (Nemeth) would go out and fool around with his girlfriend in the garage and leave just one person in care of all the kids which is
illegal," Edwards said.
After quitting, Edwards said she reported Nemeth to Child Protective Services.
"They went in and looked around and we heard back from them in about a week, and they said that they found nothing, and honestly, it was shocking," said Edwards.
Edwards said she believes CPS could have prevented Louis' death.
Nemeth has not responded to requests for comment, and 10News learned he is currently not in police custody. Child Protective Services officials have not responded to a request for a comment on this story.
Neighbors told 10News Nemeth moved out of his Clairemont home weeks ago.
