POWAY, Calif. - A family has filed a multi-million dollar wrongful death lawsuit against the city of Poway over the death of a woman in 2011.

The family of Sharlotte Kingston calls a scenic stretch of road in Poway a deadly place. Kingston was walking her dog in September 2011 when an out-of-control truck struck and killed her as she walked on Valle Verde Road.  

The truck belonged to Green Horizons Landscape, but neither the company nor the truck's driver were charged. Kingston died in the hospital two days after being hit, leaving behind a husband and three boys.

The lawsuit contends overgrown foliage blocked Kingston from seeing the oncoming truck. The suit claims the foliage was so overgrown it violated the city of Poway's own ordinances regarding how greenery must be maintained.

Kingston's husband is seeking more than $18 million in damages.

10News tried to get a response from the city of Poway, but calls to the attorney who represents the city were not returned.
