Attorney Sends Letter To Alpine Businesses

He calls himself a warrior for the disabled, but others call him a greedy lawyer.

Attorney Theodore Pinnock, who filed suit against a slew of businesses in Julian, is now targeting another community.

First came the so-called "Julian Experiment" -- nearly 67 businesses were sued by Pinnock over disability access.

The experiment is now expanding.

"We're in complete shock," said Aleicha Harman.

Harman is co-owner of The Biker Shack in Alpine. A few days ago, she got a letter from Pinnock.

Pinnock has cerebral palsy and is in a wheelchair.

The letter states Harman's store is being sued for non-compliance with disability requirements, offering a settlement for tens of thousands of dollars.

"It says if you want to stay out of court, pay this, otherwise it's going to go up," said Harman.

She isn't alone. So far, 17 other Alpine businesses have also received letters.

"It feels like an attack on the community, bringing everyone in compliance with ADA requirements," said Dean Steven Woolley, with Apline ATV & Saw.

In the case of Alpine Liquor, owner Mike McKany said he can't explain why he got the letter.

McKany said a few years ago the State Lottery Commission came by and checked the store. The entranceway and disabled parking were in compliance.

McKany called the suit, "frivolous, motivated by greed" and vows to fight back with the help of diabled customers.

"We already have customers planning on testifying and writing letters on our behalf," said McKany.

Also fighting back is a coalition led by the Alpine Chamber of Commerce.

The coalition concedes the suits have created more awarness about disability compliance, but disagree with the tactics.

It's preparing a forum on the issue next Thursday.

Meanwhile, 10News did try to reach Pinnock and was told he was unavailable for comment.
