Former Councilman May Be Retried For Felony Corruption
Zucchet Acquitted Of Extortion Charges

SAN DIEGO -- Former San Diego City Councilman Michael Zucchet is due in federal court Monday to find out if the U.S. Attorney's Office plans to retry him on two felony corruption counts. Zucchet, fellow ex-Councilman Ralph Inzunza and Las Vegas lobbyist Lance Malone were convicted last July 18 of wire fraud and extortion charges. Last Nov. 10, U.S. District Judge Jeffrey Miller acquitted Zucchet of seven of nine charges and ordered a new trial on the remaining counts of wire fraud and wire fraud conspiracy. In his reversals, Miller cited insufficient evidence to prove that Zucchet knew about a plan to exchange campaign contributions from Malone's boss, strip club owner Michael Galardi, for official action to repeal the city's "no- touch" adult dancing ordinance. In December, prosecutors filed a notice with the U.S. Solicitor General's Office, which makes decisions about federal appeals and represents the United States before the U.S. Supreme Court. Inzunza and Malone were sentenced to prison terms, but Miller allowed them to post bail and remain free pending appeal.
