City Council Trial Judge Considers New Trial
Hearing Resumes Thursday At 1:30 P.M.

SAN DIEGO -- Former Councilmen Ralph Inzunza and Michael Zucchet and lobbyist Lance Malone, who were all convicted in a City Council corruption trial, asked for a new trial Wednesday and the judge is taking the request under advisement.U.S. District Judge Jeffrey Miller ordered everyone back in court Thursday at 1:30 p.m.Sentencing for Malone was scheduled for Wednesday. He was the Las Vegas lobbyist who conspired with a strip club owner and city councilmen to trade campaign contributions for efforts to repeal a "no-touch" dancing law.Federal prosecutors have recommended a sentence of 57 months in prison for Lance Malone.Malone's attorney, Dominic Gentile, said in court documents that his client's convictions should be set aside or a new trial granted because the jury was wrongly influenced by political scandals in San Diego.Malone was convicted July 18 of one count of conspiracy to commit wire fraud, 33 counts of wire fraud and three counts of extortion.Councilmen Ralph Inzunza and Michael Zucchet were also convicted and resigned.Inzunza was found guilty of one count of conspiracy to commit honest services wire fraud, nine counts of wire fraud and three counts of extortion.Prosecutors have also recommended a 57-month sentence for Inzunza.Zucchet was convicted of one count of conspiracy to commit honest services wire fraud, five counts of wire fraud and three counts of extortion. He was acquitted of 28 additional wire fraud counts.A third indicted councilman, Charles Lewis, died in 2004 of complications from liver disease.Council aide David Cowan was acquitted of making a false statement to the FBI.Inzunza and Zucchet are scheduled to be sentenced Thursday.
