Congressman Maintains His Innocence

A software firm that says it was bilked by a San Diego company could soon find out why it was never paid, 10News reported.

The local company was First Auditors, which U.S. Rep. Randy "Duke" Cunningham recommended for a multi-million-dollar federal contract.

Although First Auditors received more than $3 million in payments from the government, it never paid its subcontractor -- software developer Integrated Actuarial Services, 10News reported.

Monday a judge ruled the software firm can subpoena First Auditors for its financial records.

"We also plan to subpoena Mr. Cunningham, so that maybe he can help us in the investigation of where the missing money went to," James Kavanagh, with Integrated Acturial Services, said.

Cunningham maintains he has done nothing wrong.

First Auditors has since gone bankrupt.
