Man Accused In Fatal Hit-And-Run To Stand Trial
Joshua Goldbaum Accused In Crash That Killed Brianna Burlington

VISTA, Calif. -- An Escondido man accused in a hit-and-run crash in North County that killed one of his passengers must stand trial on charges of gross vehicular manslaughter, DUI with injury and hit-and-run causing death, a judge ruled on Wednesday.
Joshua Goldbaum, 27, faces more than 20 years in state prison if convicted in the death last October of 21-year-old Brianna Burlington.Goldbaum and another passenger in the defendant's 2000 Hyundai Sonata, Nicholas McGill, received minor injuries.Vista Judge Richard Mills ruled after a two-day preliminary hearing that enough evidence was presented for Goldbaum to stand trial. A Superior Court arraignment was set for Feb. 1.Authorities said Goldbaum was driving the Sonata that collided head-on with a Ford Aerostar van on Bear Valley Parkway at San Pasqual Valley Road at 2:22 a.m. last Oct. 8.According to a search warrant affidavit from the CHP, Goldbaum persuaded a woman who had stopped to help to take him to the hospital. On the way there, the warrant states, the defendant convinced the woman to take him home.Goldbaum left his wallet in the woman's car, and when she learned he was the driver in a fatal hit-and-run crash, she called police, according to the affidavit.The defendant was arrested at his home around 9 a.m.McGill told police that Goldbaum had ingested cocaine and drank at two bars hours before the crash.Goldbaum drove at speeds of more than 80 mph down Bear Valley Parkway before running a red light and crashing into the van, according to the affidavit.Attorneys said Goldbaum's blood-alcohol level was .08 percent at the time of driving.DNA taken from the driver's seat matched the defendant, said Deputy District Attorney Marlene Coyne.She said a CHP officer testified that in his opinion, Goldbaum was under the influence of alcohol, marijuana and a stimulant.Goldbaum was convicted of assault in 2008 in San Diego County, Coyne said.
