San Diego -- The trial that was scheduled to begin Monday for a man accused of raping his 82-year-old aunt after she injured herself getting out of bed has been rescheduled to June 28.Jonathan Wells, 50, faces charges of forcible rape, burglary and elder abuse.At the defendant's preliminary hearing, the alleged victim said Wells had spent two years working on repair projects on her Encinitas mobile home and stayed there several nights a week.
On the night of May 20, 2003, the woman said she was unable to sleep after having "a couple of drinks" with Wells.She said she got out of bed and walked to the living room to watch television but fell over her nephew's boots, hurting her head and back.She said she managed to get back into bed, but Wells then appeared in the room naked."He says, 'Move over,"' the victim has testified. "I said 'No, I sleep here.' I was in pain from the falling."Wells then held her down by the neck and raped her, she said.The victim testified that she told Wells five or six times to stop because he was hurting her, but he just told her to shut up."He said 'I've been waiting two years for this, and I'm not going to stop now,"' she testified.The next morning, an ambulance took the woman to Scripps Hospital in Encinitas, but it was hours before she told a social worker what happened, according to her preliminary hearing testimony.Sue Dickinson, a nurse specializing in examining rape victims, testified she found injuries consistent with the victim's account.
