Potential Jurors Questioned On Tuite's Escape

Survey Asks If Escape Would Affect Their Opinion

Potential jurors in the Richard Tuite murder trial returned to court Friday morning, 10News reported.

They dropped off a questionnaire they received on Monday and were given a new list of questions that pertain to Tuite's escape.

Those questions were:

1. What information have you seen or heard about Mr. Tuite since you left the courthouse last Monday?

2. If you have seen or heard information about Mr. Tuite since last Monday, please describe how, if at all, this has affected your opinion about Mr. Tuite or this case.

3. Do you believe you will be able to set aside any such information and decide this case only on the evidence presented in court during the trial? Yes. No. Explain.

Nearly all jurors said they had seen or read news that Tuite slipped out of his handcuffs and walked out of the courthouse, forcing a massive manhunt that led to his capture about 3.5 hours later.

But only a few of the 100 or so potential jurors said that information would actually prevent them from being able to serve on Tuite's jury.

Prosecutors said this isn't the first time Tuite has behaved in a sneaky way. They want the judge to allow evidence of his escape to show that, although schizophrenic, Tuite has the ability to plan and scheme.

Judge Frederic Link said, "I'm not going to let you do that."

But the judge will give the jury a "flight instruction," which basically means he will tell jurors they can consider the fact that Tuite fled from prosecution as evidence of a guilty mind.

Link wants to finish selecting the jury by next Tuesday. Opening statements are expected to begin Feb. 17.
