A La Jolla band teacher is accused of raping and molesting a 16-year-old high school student, 10News reported.

Oscar Rodriguez

Oscar Rodriguez, (pictured, left), taught music theory and band at both La Jolla High School and Muirlands Middle School. He has been on administrative leave since Oct. 21, 2003 after police began investigating the sexual assault charges.

Rodriguez faces several rape charges, as well as five counts of child molestation.

District officials did not tell students or parents about Rodriguez at the time of the investigation.

Peri Lynn Turnbull, a San Diego City Schools spokeswoman, said, "During an investigation we don't inform parents in any public way because as you know, the employee does have the right to privacy, as do any of the students who may have been involved."

Rodriguez was arraigned Jan. 12. He will return to court for a hearing on Feb. 11.
