Andres Villota Accused Of Ties To Mexican Mafia

SAN DIEGO -- A jury will now decide the fate of a San Diego County sheriff's deputy accused of having ties to the Mexican Mafia.On Monday, Andres Villota testified that he filed a less than complete report about finding a box at the San Diego County Jail with tennis shoes and a large amount of drugs hidden inside.Villota turned it in, but did not name any suspects. He said he conducted an investigation on his own on the 8th floor, where several Mexican Mafia defendants were being held. He testified that he got nowhere and said, "So I was asking everybody else, about 4 or 5 cells. Everyone denied it."Villota said FBI investigators were bombarding him with questions and he finally agreed with them.Deputy District Attorney Leon Schorr asked, "Do you remember telling them, 'Yes, I falsified a report?""Yes, I remember that," Villota responded.The district attorney built the case against Villota on the basis of a confidential informant, Andrea Gomez. She wore a body-wire to obtain evidence against the Mexican Mafia, resulting in a major operation in early 2009. She also told the FBI she could help them get Villota. A recording was made of her offering him $100 for favors, but he refused it. However, he never reported it to authorities, prosecutors said.Authorities said the felony charge levied against Villota is about that shoe box with drugs and his official report in which he named no suspects.Schorr argued, "We're talking suspects, not defendants. Not if they should be charged with a crime; his duty was whether or not he had suspects. He should have included that in his report and he did not do so."Defense attorney Ward Clay said Villota was being thrown under a bus and that the evidence is all smoke and mirrors."What evidence do we have of that? Nothing. What's in it for him? Nothing. What's the motive? Nothing," said Clay.The jury begins deliberations on Tuesday.
