4 Local College Students Charged In Death Of Fellow Student
Investigators Say 4 CSU Students Violated Social Host Ordinance

SAN DIEGO -- Four local college students are facing charges in connection with the death of a fellow student at a 2009 fraternity house party.More than a year after his death, CSU San Marcos students Brendan Urias, Mike Naylor, Kyle J McCarthy and Morgan Lawler all face misdemeanor charges of violating the social host ordinance. The ordinance forbids the provision of alcohol to people under 21.Patrick Drown, 19, was killed on the morning of August 15 after he was struck by a car on Buena Creek Road in San Marcos. Earlier that evening, prosecutors said Drown had been at a party organized by the four defendants. Drown and the four defendants are members of the Sigma Alpha Epsilon fraternity.An investigation conducted by the Alcohol Beverage Control Commission showed alcohol was flowing freely at the party where, according to the investigation, most people in attendance were under 21.Sometime after 1:00 a.m., as the party was winding down, prosecutors said Drown wandered away from the house and eventually ended up about 100 feet away in the middle of Buena Creek Road. He was hit and killed by a driver in a BMW. The driver was not charged, authorities said.The ABCC investigation revealed the four defendants knew that Drown was very drunk. He had fallen asleep in the backyard of the home earlier in the evening and had to be helped back into the house.On Thursday, Drown's parents, Charlie and Debbie Drown, said the charges against their son's friends bring no comfort."It's not gonna bring our son back. Nothing will," said Debbie Drown.While the Drowns said they hold no ill will toward the four defendants, they also said there should be consequences for actions that have left them devastated."They didn't take care of him. They didn't lock the door to make sure he didn't walk out the door. They put him on the couch drunk and then went to bed and didn't worry or think about him," Charlie Drown told 10News.The couple said they hope more than anything else that an important message gets out there so something like this doesn't happen to someone else's child."Until someone says, 'You know, hey, this has gotta stop' or 'if something like this happens, there's gonna be consequences,' it's gonna continue to happen" said Charlie Drown.The maximum the defendants could face if convicted is 6 months in jail.10News attempted to reach the national office of the Sigma Alpha Epsilon fraternity for a comment, but a phone call wasn't returned.A spokeswoman for Cal State San Marcos said the condolences of the school go out to the family and friends of Patrick Drown.The spokeswoman said the school attempts to teach students about the dangers of drinking and tries to give them tools to deal with peer pressure.
