A Marine accused of assaulting his girlfriend in Oceanside last weekend is due in court on Thursday for a misdemeanor charge of domestic violence battery, a prosecutor said.

Brian Eric Ruybal, 25, was arrested Sunday by Oceanside police as he tried to enter Camp Pendleton, where he lives.

Oceanside police said Ruybal and his girlfriend were at an off-base residence on Saturday when she announced that she was breaking up with him. He allegedly responded by holding her against her will for about three hours, choking her at least once and threatening to kill her.

Prosecutors reviewed the case and charged Ruybal with the misdemeanor, said Deputy District Attorney Marnie McGee.
