Coast Guard Sets Hearing On SD Boy's Death

Anthony DeWeese, 8, Died In Dec. 20 Collision

A hearing is scheduled for Tuesday for three members of the U.S. Coast Guard charged in connection with the death of a boy who was aboard a boat struck by a Coast Guard cutter in San Diego Bay, it was announced Friday.

The Article 32 hearing, the military equivalent of a preliminary hearing, will take place at the USCG 11th District Headquarters in Alameda.

A 33-foot Coast Guard cutter and a smaller pleasure boat collided last Dec. 20 during the annual "Parade of Lights," killing 8-year-old Anthony Cole DeWeese of Rancho Penasquitos and seriously injuring another boy.

Authorities said the USCG boat was responding to a report of a grounded boat at the time, but Mike Neill, a lawyer for the DeWeese family, said the government vessel was seen speeding earlier that night.

Petty Officer 3rd Class Paul A. Ramos, the coxswain, is charged with involuntary manslaughter, aggravated assault, hazarding a vessel and dereliction of duty.

Petty Officer 2nd Class Ian M. Howell, is charged with negligent homicide, aggravated assault, suffering a vessel to be hazarded and dereliction of duty. Howell was the Officer of the Day at the San Diego Coast Guard Station.

Petty Officer 3rd Class Brittany N. Rasmussen is charged with negligent homicide, aggravated assault and dereliction of duty.

A fourth crewman, Petty Officer 3rd Class Lavelle M. Teague, is charged with dereliction of duty, but his case is not part of the upcoming hearing.

DeWeese was on a 24-foot craft, the Sea Ray, with three families, watching the holiday parade of about 80 decorated boats. He was rushed to a hospital but died of his injuries.

A 4-year-old boy sitting next to Anthony suffered a fractured skull, but is recovering.

After the hearing, Rear Adm. Joseph Castillo, who brought the charges, will decide how the case will proceed.
