Jogger Says Gardner Attempted To Rape Her

SAN DIEGO -- A woman who said she was attacked at a Rancho Bernardo park by accused killer John Gardner talked about the incident on CNN Tuesday.In an interview on CNN's "Larry King Live" show, jogger Candice Moncayo described the December attack in Rancho Bernardo Community Park and what the man accused of killing Poway teen Chelsea King said during the attack."He threw me down onto the ground and pinned me to the ground. I was screaming, and he said, 'Shut up' and I said no. He told me to shut up again and I said no. And I said you have to kill me first because I thought he was trying to rape me. He said, 'That could be arranged,'" said Moncayo.Moncayo, a Colorado college student, continued to scream and fight."At one point, he picked me up by my shoulders and started shaking me the way you are not supposed to shake a baby, and I managed to put one hand on the ground and I picked up my arm and I bashed him in the nose," said Moncayo.With local state Assemblyman Nathan Fletcher by their side, Chelsea parents, Brent and Kelly King also spoke on the show. Kelly King reacted to Moncayo's first-hand account and said it was painful to listen to."To hear what a victim has to go through when attacked like this. It's extremely difficult ... it's multiplied 1,000 times when it's your own daughter that's been through it as well," said Kelly King."It's clear in this case the system failed. You had a known sex offender whose psychology report said he will re-offend. He's a danger to society. He's callous. He violated his parole seven times, yet he was still let out. I think it's imperative that we do everything possible to change this," said Fletcher.Late Tuesday, Fletcher announced he would ask the state to change its parole policies in what could become "Chelsea's Law" and mandate that all sex offenders who violate their parole get a formal case review.
