Expert: Sexually Violent Predator Lied During Routine Test
Matthew Hedge Accused Of Violating Release Terms

SAN DIEGO -- A sexually violent predator lied about violating terms of his outpatient status during a polygraph test last month, an expert testified Wednesday.Darryl Bullens, who administers polygraphs for the agency that monitors sexually violent predators, testified during the first day of a hearing to determine if Matthew Hedge should be returned to a state mental hospital for further treatment.Hedge, 46, was arrested Nov. 5 at his trailer near Donovan State Prison in Otay Mesa after Bullens reported his findings to a community safety team responsible for keeping on eye on Hedge.Bullens said Hedge told him that he masturbated to women's volleyball on television, possessed a vibrator and used it for masturbation, wore his wife's underwear as a joke and took pictures with his cell phone.When asked if there were any more violations of his conditions of release that he hadn't disclosed, Hedge said "no," Bullens said.The polygraph indicated "deception" and showed Hedge as being "untruthful" Bullens said.Later, Hedge admitted taking pictures with the cell phone of his female driver "Frances" with her legs crossed because he thought it looked sexy and wanted to use the photo to masturbate, Bullens testified."He basically said, 'I'm sunk now, because I violated these terms,'" the witness testified. "He said, 'It's over.'"Bullens said he immediately called the community safety team and recommended that Hedge's outpatient status be revoked.The expert said Hedge would not or could not control his behavior, calling it "unacceptable. Hedge had not told his treatment team about the violations, Bullens said."This individual chose to lie and withhold information," the polygraph expert said. "Mr. Hedge is still a question mark."Judge Michael Wellington granted a request from Hedge's attorney, Marian Gaston, to administer another polygraph to Hedge in the near future.Deputy District Attorney Phyllis Shess told the judge that Hedge has a history of being less than truthful with his treatment team.David Forester, who was assigned to supervise Hedge, testified that he told Hedge not to use the camera on the phone.When he learned of the photo of the female driver, Forester said he confronted Hedge, and Hedge said he deleted it.Because Hedge withheld information and lied, Forester said he recommended that Hedge be taken into custody.As they were leaving Hedge's trailer, Forester said Hedge told him, "Dave, I just don't know why I do these things," Forester testified.Hedge pleaded guilty in 1989 to molesting four children in San Diego and served 12 years in prison, He was committed to the sexually violent predator treatment program in 1997.In 2005, Hedge was ordered for the first time into outpatient treatment but his status was revoked within six months after he talked to two girls at a treatment center, lied to staff and had a deviant sexual fantasy about a child.After two more years of in-patient hospital treatment, the court again in October 2008 granted Hedge's petition to be placed in outpatient treatment.Hedge will placed at the Otay Mesa site in April.During a brief hearing following Hedge's Nov. 5 arrest, Gaston told Wellington that Hedge was not accused of committing any new crimes and has not had any thoughts of assaulting children.Gaston said that Hedge was fantasizing about adult women and not children, and his treatment is working.The hearing will resume Thursday.
