5th-Grade Teacher On Trial For Sex With Students

POSTED: 5:08 am PST November 30, 2009
UPDATED: 12:49 pm PST November 30, 2009

A fifth-grade teacher sexually molested two boys who had been in her class, a prosecutor said Monday, but a defense attorney said the mother of one of the boys had an ulterior motive to falsely accuse the defendant.

"This case is about a violation of trust," prosecutor Wendy Patrick told the jury in her opening statement in the trial of 36-year-old Adrienne Feistel.

Feistel, 36, is charged with multiple counts of committing lewd acts on a child and faces more than 10 years in prison if convicted.

The prosecutor told the jury that Feistel would become close to the victims' families and molest the boys after that.

A fellow teacher told a district attorney investigator that Feistel was obsessed with Mary Kay Letourneau, a former elementary school teacher convicted of raping a 12-year-old student, whom she eventually married.

In one instance, the defendant became best friends with the 16-year-old sister of a boy named Christian, who was 12 when the molestation started in 2006, Patrick said.

Feistel complained that the boy wasn't paying enough attention to her, then moved in with Christian's family when she separated from her husband, the prosecutor said.

Christian, now 15, testified that Feistel would come into his room at night and molest him.

The first time, Feistel got in bed with Christian and started kissing him, he testified.

During a third late-night visit, Feistel touched "my privates," the boy testified.

Feistel told the boy it would "feel good" with her mouth on his privates and during another visit she orally copulated him, he testified.

The defendant also asked Christian to put his mouth on her breast, which he did, he testified.

Feistel also asked the boy to have sexual intercourse with her, but he said he refused.

Christian said Feistel had to move out after his mother came in his room one morning and caught them in bed together.

The boy told three friends what was happening with Feistel but didn't tell any adults until August 2008, when the police were called to his home to break up an argument between his mother and his sister, he testified.

The other alleged victim, Antonio, acknowledged having sex with Feistel before he turned 18, Patrick said.

Defense attorney Anna Yum told the jury in her opening statement that Christian's mother, Maria, falsely accused Feistel of molesting her son to protect herself and regain control of her relationship with her older daughter.

The day of the mother-daughter argument, the daughter called Feistel to "save me from my abusive mother," Yum told the jury.

The attorney urged jurors to assess the credibility of witnesses whose testimony will be based on "gossip and innuendo."

Yum said Antonio never once said he was under 18 when he had sex with Feistel.

The attorney told the jury there will be a lack of credible evidence to prove her client guilty.
