Man In Normal Heights Standoff Pleads Not Guilty

SAN DIEGO -- A man who allegedly pointed a rifle at police serving a narcotics-related search warrant, prompting a detective to fire at the suspect at the outset of a two-hour standoff, pleaded not guilty Friday to felony charges.David Michael Darcy, who was ordered held on $200,000 bail, is charged with assault on a peace officer and resisting an executive officer by threat or violence.Deputy District Attorney Stephen Marquardt told Judge Charles Gill that police were executing the search warrant at the defendant's upstairs apartment in the 4300 block of 33rd Street in Normal Heights on Tuesday night based on information that Darcy may be involved with narcotics.
As officers entered the apartment, a detective noticed the 31-year-old defendant in a hallway pointing a rifle at officers in a "ready to fire" position, the prosecutor alleged.The detective fired at the suspect, who was not hit and retreated to a bedroom, Marquardt said. A two-hour SWAT standoff ensued, causing the evacuation of nearby homes and businesses, according to the prosecutor.Defense attorney Brian McCarthy told the judge that Darcy thought someone was breaking into his apartment and it turned out to be the police.Darcy was also told via a cell phone call to stay in his apartment, which he did, his attorney said."He was shot at by the police," McCarthy told the judge.Darcy faces eight years and eight months in state prison if convicted.A bail review was scheduled for Wednesday, with a readiness conference set for Nov. 10 and a preliminary hearing for Nov. 13.
