SAN DIEGO -- A teen accused of crashing a car carrying four of his Torrey Pines High School classmates as they left a party, killing one of the boys, will not be charged as an adult, a district attorney's spokesman said Tuesday.The driver, identified as 17-year-old Branden Butler, was not hurt in Sunday's crash and was being held at Juvenile Hall on suspicion of felony driving under the influence and gross vehicular manslaughter.A detention hearing could be held for Butler on Wednesday. Paul Levikow, a spokesman for the District Attorney's Office, would only say that the teen would not be charged in adult court.An initial California Highway Patrol report said a combination of alcohol and speed contributed to the pre-dawn accident.Alexander Michael Capozza, 17, died at 1:43 a.m. Sunday in the 5000 block of La Granada in Rancho Santa Fe when the speeding 2008 Mazda 3 crashed and rolled several times, ending up in some bushes, according to the San Diego County Medical Examiner's Office.Another passenger, identified as 17-year-old Jamie Arnold, was not wearing a seat belt and was critically injured in the accident, while the other two 17-year-olds escaped serious injury, authorities said.CHP Sgt. Lewis Hall said his agency and the state Department of Alcoholic Beverage Control are trying to determine where the students had been drinking, how they acquired the alcohol and whether adults were involved. He also said illegal drugs may have been a factor.
