Pedicab Driver Not Charged In Passenger Death

SAN DIEGO -- Prosecutors declined to file charges Thursday against a pedicab driver arrested on suspicion of manslaughter after a Fourth of July accident that killed one of his passengers, a retired schoolteacher.Sukru Safa Cinar, 23, was released from jail Thursday night pending further investigation, said District Attorney spokesman Paul Levikow.Cinar was arrested Tuesday in connection with the death of 60-year-old Sharon Miller.The fatal accident occurred shortly before noon Saturday on Martin Luther King Promenade.Miller, who was riding in Cinar's three-wheeled pedal taxi with a friend, fell out as Cinar allegedly swerved from side to side on the pedestrian path, where he was riding in violation of posted signs, said San Diego police Assistant Chief Guy Swanger.The Illinois resident, who was in San Diego with her husband to attend a national education conference, fell onto a sidewalk and suffered a severe head injury. She was pronounced dead Sunday at UCSD Medical Center in Hillcrest.Cinar's pedicab was not equipped with seat belts, authorities said.
