SAN DIEGO -- A judge has ordered a Washington state couple who pleaded guilty to felony child abuse in their baby's overdose death released after 15 months in a San Diego jail.Thomas and Lorrie Boettger of Shelton, Wash., were visiting the city with their 6-month-old son Thomas in October 2006 when they gave him a fatal dose of antihistamine and a sleeping aid.The Boettgers, both 39, told investigators they put the medicine in the baby's bottle to calm his gastric upset.
They were jailed in March 2007.Superior Court Judge Michael Wellington sentenced the Boettgers Friday to two years in prison but gave them credit for time served.Prosecutors said the pair ignored printed warnings about giving adult medication to infants.
