Witness: Surfer Kicked, Sucker-Punched

SAN DIEGO -- Testimony is expected for a fifth day Wednesday in a preliminary hearing for five young men accused in the beating death of a professional surfer during a fight outside his home in La Jolla last year.Seth Cravens 22, Eric House, 21, Orlando Osuna, 23, Matthew Yanke, 21, and Henri Quinn-William Hendricks, 22, are charged with murder in the death of 24-year-old Emery Kauanui.San Diego police Officer Marco Crisostomo testified Tuesday that the victim's ex-girlfriend told him that Yanke and Osuna were beating and kicking Kauanui on the ground and that Cravens punched him in the face when he got up.Kauanui, 24, fell unconscious after the melee last May 24 and died four days later from a brain injury.In addition to murder charges, the defendants are charged with gang allegations and other counts in connection with Kauanui's death.Crisostomo, who along with his partner was first at the scene, testified that Jennifer Grosso told him that Kauanui called her the night of the fight and said he had gotten into an argument at the Brew House and that she should pick him up.Shortly after they arrived at Kauanui's home, Grosso testified, a black SUV pulled up, four young males got out, and Kauanui started arguing and fighting with them, the officer testified.Grosso said one of the males got on top of Kauanui, and she tried to pull him off, but another male she identified as Yanke pulled her off the pile, Crisostomo testified.Once Kauanui got to his feet, Cravens sucker-punched the victim, causing him to fall back and hit his head on the pavement, the officer said Grosso told him.The woman said Osuna and Yanke were kicking and punching Kauanui before he got off the ground the first time, according to Crisostomo.Grosso said she knew the young males from La Jolla High School, which she also attended, the officer testified.She said the group called themselves the Bird Rock Bandits, Crisostomo testified.Grosso told another detective that after Cravens punched Kauanui, Yanke and Osuna "were getting their final kicks in."A witness who heard the commotion told a detective that after Kauanui hit the ground for the last time, a man identified as House said to the victim, "I'm sorry, I'm sorry."San Diego police Detective Dana Hoover testified that Phillip Baltazar told her that he looked out his window and saw a man sitting on Kauanui and punching him.The man doing the punching got up, stood over Kauanui, and checked his pulse, the witness said, according to Hoover.At the conclusion of the preliminary hearing Einhorn will decide if enough evidence has been presented to order the defendants to stand trial. Each faces 15 years to life in prison if convicted.
