Man Accused Of Shooting Uncle Pleads Not Guilty

SAN DIEGO -- A man accused of repeatedly shooting his uncle and clubbing him with a baseball bat after an argument at the victim's Encanto home pleaded not guilty Wednesday to charges of attempted premeditated murder and assault with a deadly weapon.Jerry William McCluney, 23, was ordered held on $1 million bail.Deputy District Attorney Allen Brown told Judge David Szumowski that the defendant returned to the victim's home around noon Monday after the two had argued earlier in the day.
The victim threw a glass vase at the defendant when he came to the front door, and McCluney left again, the prosecutor said.Brown alleged that McCluney came back to the residence in the 6400 block of Edmonds Street with a gun and shot 47-year-old Brian Gooden twice in a bedroom.McCluney then allegedly put the gun in his waistband, picked up a baseball bat and hit the victim six to eight times, according to the prosecutor's account.Gooden got the defendant in a "bear hug" to stop the beating, but McCluney managed to pulled out the gun again and shot the victim once more, then fired two more times, leaving him with at least four bullet wounds, the prosecutor alleged.McCluney, who was arrested at a home about a quarter-mile from the shooting scene, faces 31 years to life in state prison if convicted.The judge set a status conference for April 16 and a preliminary hearing for April 22.
