Westerfield Trial Set To Get Under Way

Opening Statements Scheduled For 10 A.M. Tuesday

Final details were hammered out Monday before opening statements in the trial of David Westerfield are made Tuesday.

Westerfield, 50, is accused of kidnapping and murdering 7-year-old Danielle van Dam, who disappeared from her Sabre Springs home on the evening of Feb. 1.

Her naked and decomposed body was found by an East County roadside Feb. 27.

All the attorneys involved in the case were in the courtroom of Judge William Mudd Monday to discuss a sealed motion.

The jury for the trial was selected with surprising speed, according to legal analysts. Jury selection took only a few days, whereas many analysts had predicted that the selection process would take several weeks.

Because Danielle's parents, Brenda and Damon van Dam, are potential witnesses in the case, Mudd has ruled that they will not be allowed in the courtroom during the trial until they have testified or been excused as witnesses.

Ten seats inside the courtroom have been set aside for the media, the remaining courtroom seats will be available to the public on a first come/first served basis, 10News reported.

Meanwhile, members of the news media spent the day settling in around the downtown courthouse in preparation for the trial, which could last as long as 12 weeks.

Gavel-to-gavel coverage of the trial will air live on NewsChannel 15, and will be live streamed on TheSanDiegoChannel.com.

Opening statements are scheduled to begin at 10 a.m. Tuesday.
