College QB Accused In Surfer's Death Pleads Not Guilty

SAN DIEGO -- A fifth young man who prosecutors said was part of a fatal group attack on a professional surfer in La Jolla earlier this year pleaded not guilty Monday to murder, assault and gang charges.Henri "Hank" Quinn-William Hendricks, 21, was jailed on $500,000 bail by Superior Court Judge John Einhorn.The judge said the defendant could use the $1 million in equity in his aunt's property to post a bond and get out of jail.Four other young men -- Seth Cravens, 21, Eric House, 20, Matthew Yanke, 21, and Orlando Osuna, 22 -- were charged on May 31 with the murder of 24-year-old Emery Kauanui.Hendricks was not originally identified as a suspect.But on May 29, the day after Kauanui died, Hendricks came forward and told police he was at the fight scene, according to an affidavit filed in support of a search warrant.Today in court, Deputy District Attorney Sophia Roach told Einhorn that Hendricks took a "calculated gamble" by telling police that the incident that resulted in Kauanui's death started out as a one-on-one fight that went wrong.After the fight, Hendricks spent the night with all but one of his co-defendants, and drove Cravens -- who is alleged to have thrown the fatal blow -- away from the scene in La Jolla.The prosecutor disputed contentions from Hendricks' attorney Richard Gates that Hendricks was on the periphery during the fatal attack.Roach said Hendricks associated with his co-defendants -- self-described members of a hard-partying crew known as the Bird Rock Bandits -- when he was on school breaks.Until being charged in Kauanui's death, Hendricks was the backup quarterback for the University of New Hampshire.Roach said Hendricks and the group started a fight last New Year's Eve when they were denied entrance to a party.When a coach came out to try to calm things down, Hendricks punched him and knocked him to the ground, the prosecutor said.Hendricks continued to fight then fled the scene, Roach said.On the night Kauanui died, Hendricks was part of a group gathered at the Brew House that made a plan to attack the victim, the prosecutor said.Investigators said the attack was precipitated by a drink-spilling incident involving House. Kauanui was driven home by his girlfriend, and the defendants allegedly followed, and House was encouraged to fight Kauanui.Once the group attack began in front of Kauanui's home, Hendricks pushed away a woman who tried to stop the fight, Roach told the judge.She said Hendricks saw Cravens sucker-punched the victim and said, "Let's get the hell out of here."Roach alleged Hendricks could have stopped the fight but chose not to."Mr. Hendricks is not different from the rest of these defendants," the prosecutor said. "It was a group action. It was not his first time."House, Yanke and Osuna have posted bail, but Cravens remains held on $2 million bail.The four will be back in court for a bail enhancement hearing on Friday.All five defendants face a maximum of 15 years to life in prison if convicted.
