The three men being held by the FBI as material witnesses in the Sept. 11 attacks investigation are believed to have spent Tuesday before a New York judge.

The attorney for Osama Awadallah, Mohdar Abdullah and Yazeed Al-Salmi said the three arrived in New York Monday and were expected to appear before a federal magistrate on Tuesday.

The FBI is eager to learn what the three know about suspects Khalid Al-Midhar and Nawaf Alhamzi. Midhar and Alhamzi are believed to have been among the five men who hijacked Flight 77 -- the flight that slammed into the Pentagon

Attorney Randall Hamud told 10News that he couldn't reveal much of what had happened Tuesday.

"I can't comment at all about anything that occurred here," he said.

But he did offer that the three are cooperating with authorities, despite recent "leaked" reports to the contrary.

The three had shared an apartment together in La Mesa, and sources said that the name of one of the three was found in Alhazmi's 1988 Toyota.

The three may remain in custody for some time, 10News reported, and may later be asked to testify before a grand jury.
