Plea Deal For Teen In Fatal Crash Could Dismiss Charges

A high school student charged with driving drunk and causing a crash that killed a classmate could receive a deal that would dismiss all charges, 10News reported.

Torrey Pines High School senior Brendan Butler appeared before a juvenile court judge Monday morning, where his attorney Dana Grimes asked the judge to consider what is known as "deferred entry of judgment." If granted, Butler would admit to all of the allegations. In return, confinement is off the table and charges are dismissed.

"He's very, very sorry for the loss that he's caused. He's really not thinking of himself at this moment," said Grimes.

Butler is charged with speeding and driving while drunk in the crash that killed his friend, 17-year-old Alex Capozza. Jamie Arnold, 17, was seriously injured in the crash but has recovered.

Grimes said this is the first time Butler has been in trouble with police.

"This has been a very disorienting experience for him. This is the first time in his life that he's been in this type of trouble, or any trouble nearly this significant. He does not want people to think that he's concerned over the stress this is causing in his life. He's really more concerned for the families of Jamie and Alex," said Grimes.

If the judge grants the defense request, Butler could possibly be released to the custody of his parents after his next hearing on November 19.
