Family Talks About Sailor Killed By Alleged DUI Driver

POSTED: 1:16 pm PDT September 15, 2009

Four Navy sailors accused of assaulting an alleged drunk driver who ran over their friend now face assault charges. The four sailors, Dante Frear, Kirk James, Andrew Sandoval, and Jamel King, appeared in court Monday.

20-year-old Aaron Garcia was killed last July on Sky Harbor Road in Paradise Hills when he was hit and dragged at least fifteen feet. Friends said Aaron was standing with a group of sailors when a Hyundai sedan careened into the group. The sedan hit two other people before killing Garcia.

Jamel King says he still has nightmares about what happened.

Garcia’s family spoke with 10News exclusively for the very first time. The family is upset because the driver has yet to be charged despite the fact authorities said that he was intoxicated at the time.

Aaron’s brother, Eric Garcia, said, “All we want is an explanation. Let me know why. Let the family know what’s really going on.”

Family members told 10News that Aaron Garcia loved music and played the trombone and tuba. He left behind a wife, Lakeshia, and three children, Kailin, Jailin, and Ariana.

10News legal consultant Jan Ronis said the case is unusual.

"It seems to me the charge of vehicular manslaughter is far more serious than what the sailors are said to have done. It sure is unusual they’ve chosen to charge these sailors as opposed to him [the alleged drunken driver],” Ronis said.

The District Attorney’s Office told 10News that the driver could still face charges. They said the assault case and the DUI case are being handled by two different deputy D.A.’s. Both cases are under review.

There is no word why the assault case is moving forward faster than the DUI case.
