Detective Says Man Stalked Children At School Bus Stop

Search Reveals Evidence Of Child Sexual Abuse Going Back A Decade

Parents keep a watchful eye on their children waiting at the school bus stop on West Clemmens Lane in Fallbrook.

This is the stop where investigators said Fernando Lopez, also known as Enrique Torres, stalked young girls.

"It's not right," said one of the girls, an 11-year-old whom 10News is not identifying due to the nature of the allegations.

She said Lopez grabbed her hand one morning, refused to let go and spoke of marriage.

"He was just saying that he'll wait for me five years, and that he'll buy me everything," she said.

The girl became frightened, started crying and told the school bus driver.

Dennis Bixler, assistant superintendant for the Fallbrook Elementary School District, said, "Our bus driver, who saw this, reported it immediately."

The very next morning, Det. Dan Laibach of the Fallbrook Sherriff substation drove to the bus stop to observe whether the man would show up again.

"It just struck me as odd," he said, and he wanted to see the behavior for himself.

He said that Lopez approached two more girls, one only 9 years old. The detective said Lopez repeated the words he's accused of using on several of his alleged victims.

"Telling her, 'You're really pretty, I want to marry you, I want to have babies with you,'" Laibach said.

Lopez was arrested, and authorities said he lived across the street from the school bus stop in an apartment complex he had managed for the past six months.

Inside Lopez's apartment, Laibach said he found evidence of child sexual abuse going back a decade.

"Polaroid pictures of him with children, engaged in sexual acts, nude," Laibach explained.

The girls in the pictures appear to be between the ages of 12 and 16 years old. A search warrant obtained by the 10 News I-Team lists how many were found along with other evidence. There were 26 Polaroid pictures of child porn, a comic book, candy, and little girl panties.

On a cell phone, Laibach said he found pictures of children in Lopez's Jacuzzi.

"He would tell them if you say anything to your parents, I can have them evicted," Laibach said.

Lopez, who has no prior sexual offenses, is in jail charged with five felonies. He declined to be interviewed by 10 News. His attorney, Lindsay Fradin, said she is "unable to make a comment at this time" due to where they are in the legal process.

The detective is trying to identify the girls in the photos, which seem to have been taken 10 years ago. He's also looking for Lopez's ex-wife to ask if she can identify any of the children in the photos.

Laiback also said he's not surprised that Lopez lived near a school bus stop.

"Pedophiles, alleged pedophiles, people who prey on children, would definitively use those areas to contact and talk to kids," he said.

The I-Team wanted to know how many registered sex offenders are living near school bus tops, which is not illegal. The 2,000-foot safe zone for schools and parks does not apply. In Fallbrook, the I-Team found two registered sex offenders living very close.

The school bus stop on Alturas Road has a registered sex offender living 413 feet away.

An even closer example is the school bus stop at Old Stage Coach and Pippin, where a registered sex offender lives 141 feet away.

Bixler pointed out, "We've just reminded our bus drivers again, to be vigilant."

The Fallbrook Elementary School District also sent letters about Lopez's arrest to parents and is reminding them that children should not walk to bus stops alone. Either an adult should be present, or children should walk in pairs, the district recommended.

Meanwhile, the number of alleged victims of Lopez has climbed to 13, a pattern of abuse Laibach said was stopped by one child, the 11-year-old girl who was brave enough to report what happened to her.

"She's definitely the hero of this whole case," Laibach said.
