Couple Awarded Over $16 Million In Sharp Lawsuit

POSTED: 4:46 pm PST December 5, 2008
UPDATED: 10:29 pm PST December 5, 2008

A jury has returned a multi-million dollar verdict in favor of a couple whose child died during delivery at Sharp March Birch Hospital, 10News reported. It's the conclusion to a story that the 10News I-Team first brought you in September.

The nine-week trial ended Friday afternoon when the jury sided with Teresa and Robert Bailey, awarding them over $16 million.

The Baileys' attorneys accused the hospital staff of ignoring warning signs when Tyler Bailey became lodged in his mother's birth canal.

The jury found that there was "misrepresentation and intentional concealment."

The bulk of the verdict -- $16 million -- was awarded due to the jury's decision that Dr. Arturo Mendoza, Director of Pathology for Sharp Mary Birch Hospital, was "reckless" and "without regard to the truth" when he performed the child's autopsy.

Attorneys for Sharp Mary Birch Hospital declined to speak to 10News.
